Charlotte Baines has practised at Wilberforce Barristers since completing her pupillage with James Sampson (now His Honour Judge Sampson) in 2001.
Charlotte specialises exclusively in Criminal Law and acts on behalf of both the Prosecution and Defence in the Crown Court.
Charlotte is a Level 4 Prosecutor and a specialist Rape and Serious Sexual Offences (RaSSO) prosecutor on the Crown Prosecution Service Advocate Panel. She has recently accepted an invitation to the 2016 - 2020 Panel.
Charlotte has a wealth of experience in dealing with heavyweight crime and is regularly instructed in the wide spectrum of offences including:
non-recent sexual allegations
sexual offences against children
conspiracies involving drugs and dishonesty
arson with intent
She is recognised as a highly capable advocate and for her ability to engage with clients from all backgrounds. Charlotte has a down to earth approach that affords her the ability to build a positive rapport with lay and professional clients.
Charlotte has previously been instructed in cases where witnesses or clients are vulnerable or labour under mental health problems, as she is known to have an empathetic and understanding approach. She recognises the complexities that often arise and is confident in dealing with the challenges such cases can bring.
Charlotte has experience in advising on psychiatric issues, dealing with experts prior to court attendances and cross-examining psychiatrists. She has also conducted a number of fitness to plead and fact-finding hearings on behalf of both the Prosecution and Defence.
Charlotte has experience dealing with other expert evidence including medical evidence in baby shaking cases, drugs analysis and valuations, cell site analysis and forensic accounting.
Charlotte is regularly instructed to represent young persons appearing at the Crown Court and also prosecutes cases involving child witnesses. She has recently conducted a Youth Court trial as a specialist RaSSO prosecutor in which the child witnesses were aged 5 and 6 and the Defendant was 15.
Her approach in cases involving sexual allegations is a fair, sensitive but robust one. Charlotte recognises well the balance required in dealing with highly emotional and intimate evidence and effective cross-examination in both her role as Prosecution and Defence advocate.
Charlotte has been led by both silks and leading juniors and works well as part of a team.
Charlotte has experience in advising and making applications on disclosure, third party material and public interest immunity issues.
Charlotte appreciates that continuity in representation is important and is always willing to hold pre-trial conferences and meetings as part of the case preparation process.
