Ashley Lambert-Jefferson mitigates non-custodial sentence.

Ashley Lambert-Jefferson recently represented a man a defendant who faced six counts,  possession with intent to supply Class A – Cocaine, possession of Class B, Possessing criminal property from March 2022 and whilst he was released under investigation was further arrested in July 2022 for identical offences. The defendant was in possession of 29 grams of Cocaine with a street value of £2,400 and £2,000 in cash.

The sentencing guidelines state a starting point of 4 years 6 months 

It was submitted that, at the time, the defendant was 20 years old, young and naïve and had caring and financial responsibilities that no 20-year-old should have to handle – he didn’t have the maturity to understand the consequences of his actions.

Appearing before HHJ Bury at Hull Crown Court, Ashley submitted that a significant period of time had elapsed since he was arrested. The delay has allowed the defendant to focus on what’s important, having started a business with a friend which although in its infancy, is providing a legitimate income – without the help from anyone. 

The court was invited to step back from imposing a lengthy period of immediate custody and allow him to work with the probation service.

The overall sentence passed was 2 years custody suspended for 2 years
