Connor Stuart successfully prosecutes at international extradition trial

05 December 2024

Connor Stuart was instructed by the specialist CPS Extradition Unit in Westminster to seek the extradition of an individual subject to a Red Notice issued by INTERPOL.

The individual was apprehended in the UK by the National Crime Agency (NCA) at Leeds Bradford Airport earlier this year under the authority of the Extradition Act 2003. The case raised pivotal legal issues, including whether the individual qualified as a fugitive from justice under international extradition protocols and compliance with international human rights obligations, including those outlined in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights (ICCPR).

At the adjourned hearing, after Connor’s detailed cross-examination of the individual and comprehensive legal arguments from both sides, the Court delivered its judgment. It ruled that extradition was lawful, proportionate, and compliant with the Extradition Act 2003 and international human rights frameworks, including the ECHR. The Court emphasised the balance between the public interest in upholding international justice and the safeguarding of individual human rights.
