Dale Brook obtains acquittals in multi-count rape case

Dale represented a client charged on a 10-count indictment comprised of rapes, sexual activity with a child, assault by penetration and intimidation, all against a child Complainant. The jury returned not guilty verdicts on all counts following a 13-day trial before HHJ Thackray KC sitting at Hull Crown Court.

The client was in a relationship with the Complainant’s mother. He was alleged to have raped and engaged in sexual activity with the Complainant whilst he was looking after her. The prosecution case was supported by an alleged confession and forensic evidence strongly suggesting sexual intercourse had taken place.

The defendant was later alleged to have intimidated the witness during the criminal proceedings.

The case centred on the credibility of several prosecution witnesses and the plausibility of an alternative explanation for the forensic evidence.

The client was acquitted of all counts following 3 days of deliberations.
