Two members of chambers appear in BBC News following a sentence that took place at Grimsby Crown Court on 28th June 2023.
The defendant appeared before the court for a Trial of Issue and a Sentence for offences including Breach of a Criminal Behaviour Order and the Possession of regulated substances.
In 2017, a Criminal Behaviour Order was imposed preventing the defendant from:
- Purchasing or attempting to purchase and storing any raw chemicals or synthesized chemicals.
- Carrying on any business involving the purchase, storage, distribution or sale of any raw or synthesized chemicals.
On 11th April 2023, the police received information that the defendant was again purchasing such hazardous chemicals and storing them at his home address. Acting on a search warrant, the defendant’s home was searched and a multitude of chemicals were located within the kitchen and the garden shed, including 700mg of Sodium Nitrate.
Over a three-day period, a multi-agency approach took place including colleagues from the Humberside Fire and Rescue Service and the Yorkshire Ambulance Service, which resulted in local residents and businesses having to evacuate the area for a period of around 8 hours.
Following a basis of plea, and a Newton Hearing in which the Learned Judge accepted the defendant’s account; the defendant received a sentence of 24 months suspended for 24 months.
