Michael Forrest secures acquittal for Client charged with attempted-rape

22 February 2024

Michael defended a Client charged with attempted rape. The trial took place over three days before HHJ Khan KC sitting at Hull Crown Court.

The allegation was made following the client being invited to another’s home and alleged to be sexually aggressive toward a female present. A witness called the police to report the incident, and when the police entered they described the female as being in a position of disadvantage, notwithstanding that, the Crown argued as per the body-camera footage, that the female was too intoxicated to consent. The female recalled nothing of the incident.

Michael was able to challenge the witness testimony under cross-examination, and details emerged such as the female making sexual remarks toward the client , and the fact the witness himself had neglected to tell such vital information to the police. Michael addressed the jury on the credibility of the witnesses’ account and his motivations for withholding such fundamental information.

The client was acquitted on all counts.

Michael was instructed by Mark East of John Robinson & Co.
