Michael Forrest successfully appeals sentence in the Court of Appeal.

Michael represented a defendant charged with Aggravated Burglary. On the day of trial, the Prosecution accepted a plea to Domestic Burglary.

The Sentencing Judge passed a sentence of 81 months.

Michael sought leave to appeal the sentence from the Single Judge. Leave was refused.

Michael authored a second grounds of appeal against the decision of the Single Judge, and attended the Court of Appeal in person on a pro-bono basis, to seek leave, and argue the sentence passed was manifestly excessive.

On the 07th September 2022, Michael appeared before Lord Justice Bean, Mr Justice Holgate and Mrs Justin Thornton. In arguing the sentence was manifestly excessive three submissions were put forward; two were upheld and described as well founded . Michael was commended for his ‘impressively succinct and focused submissions’.

Leave was granted to appeal.

The appeal was allowed.

The original sentence of 81 months was quashed, and a sentence of 65 months was imposed.
