Rachel, instructed by the Crown Prosecution Service, prosecuted a serving prison officer who in the course of his service, had assaulted and beaten a serving prisoner. The incident was captured on Close-Circuit Television Footage where the Officer threw a headbutt, punches and a number of kicks. In the course of evidence, the Officer stated he believed the prisoner had a weapon and so the Officer carried out a preemptive strike; Ms Scott in cross examination, drew attention to the fact that the Officer’s justification was in direction contravention to the Officer’s training, and his attacks were not in-fact defensive.
The Jury unanimously convicted the Defendant.
