All of the senior members of the team are available to advise or represent parties in cases arising out of the use, transfer and development of land. Issues covered include the validity and interpretation of options, contracts and leases, land registration, joint ownership and TOLATA, adverse possession claims, covenants, easements, boundary disputes, nuisance claims and cases about the duties of estate agents and valuers. We also have experience of local government property and obligations, including highways and public rights of way.
We have experience of dealing with all of the issues arising from contracts for the sale of goods, including international contracts, contracts for the supply of services, and contracts for the sale and purchase of businesses and business assets.
We have long experience in all types of commercial and residential letting disputes. Our work has included advising on forfeiture, landlord’s consent, renewals under the Landlord and Tenant Act 1954, rent reviews, disrepair and guarantors’ liability. We have particular experience in relation to public houses, restaurants, leisure parks and retail units, and frequently act for most of the largest public house companies in the UK. We also have a specialism in contractual and statutory arbitrations relating to lettings.
We are able to advise and act for parties in cases relating to the validity and interpretation of wills, Inheritance Act claims, and cases involving issues of capacity or of undue influence.
The junior members of the civil team are available to accept instructions in cases allocated, or likely to be allocated, to the Fast Track or the Small Claims Track. These can include housing (nuisance, disrepair and similar claims), consumer law (contracts for cars, caravans, motor homes and other consumer goods) and personal injury (occupiers’ liability, employers’ liability, road traffic, slipping/tripping and similar claims).
