Benjamin was instructed on behalf of the widow of a truck driver killed in a double fatality road traffic accident between two articulated lorries, at Caenby Corner on Christmas Eve 2024.

Paul Smith, Senior Coroner for Lincolnshire, recorded verdicts of death by Road Traffic Collision in both instances but noted various points regarding the manner of the collision including that the other driver had lost control of his truck and that he had potentially overcorrected or had a momentary lapse of concentration.

“[The other driver] permitted his vehicle to veer to the side. That was as a result of momentary inattention.”

“That was a situation that lasted only a few seconds before [the other driver] took remedial action. I’m satisfied [the other driver] lost control. It rolled into the path of the vehicle driven by [Mr. Rose’s driver]”   

“It was impossible for either vehicle to stop,”
